Physician’s Preference Warns of FDA’s Assault on Dietary Supplements in US Physician’s Preference

Physician’s Preference, vitamins & supplements, (PPVS) warns Americans of an immediate threat to all dietary supplements formulated in the United States after 1994. The U.S. Food and Drug Administration’s (FDA) most recent assault on the nutritional industry emerges from a technicality in the Dietary Supplement Health and Education Act (DSHEA) of 1994. The enforcement of this technicality could eliminate nearly all vitamins, herbs and supplements from the U.S. marketplace.
On July 1, the FDA issued a draft guidance for complying with the New Dietary Ingredient (NDI) notification protocols contained in the DSHEA, a law passed by Congress in 1994 to protect dietary supplements from being regulated out of existence by the FDA. The issuing of new guidelines on the NDI protocols has sparked concern for many in the vitamin and supplement industry as well as consumers as the new guidelines grant the FDA virtually limitless power to ban any ingredient introduced into the marketplace after 1994. In particular, this threatens all natural supplement ingredients existing in the marketplace today since there are few supplements that can be proven to have been widely used before 1994.

“The FDA’s attempt to take ‘Gatekeeper’ status in the nutritional supplement industry in effect could nearly eliminate natural products from the marketplace strictly limiting access for consumers who have come to rely on these safe products derived from Mother Nature,” said Steven F. Hotze, M.D., founder and CEO of Physician’s Preference. “It is my belief that the draft guidance oversteps the original intent of Congress in issuing the DSHEA in 1994. I also question the FDA’s true motives as it could merely be a step to protect the interests of Big Pharma.”
